Gymboree Mother’s Day 2023 Giveaway Rules

ELIGIBILITY: Open to legal residents of the fifty (50) United States and District of Columbia, 18 or older. Employees of The Children’s Place Services Company, LLC (“Sponsor”), its parent, subsidiaries, affiliates and advertising and promotion agencies (collectively with Meta Platforms, LLC dba Instagram, “Released Parties”) and members of their immediate family (spouse, parent, children, siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, are not eligible. Void where prohibited. Sweepstakes is subject to all applicable federal, state and local laws.
HOW TO ENTER: Each day at or around 3:00 p.m. Eastern Time (“ET”) between May 8, 2023 and May 13, 2023 (the “Sweepstakes Period”) @gymboree will post an in-feed image or video (a “Post”) referencing the Gymboree Mama Knows Best Giveaway. The Post will include a memory game with 8 numbered tiles, only 2 of which will be matching. One at a time, each tile will flip over revealing the image on the opposite side. To enter, you must (i) follow @gymboree on Instagram (ii) “like” the applicable Post, (iii) leave a comment with the brain emoticon on the Post, and (iv) direct message @gymboree correctly identifying the numbers of the two matching tiles that appeared in the Post. All entries for a particular Post must be received by 8:00 p.m. ET on the applicable day during the Sweepstakes Period. Individuals must correctly identify by number the two matching tiles. If no eligible individual correctly responds by 8:00 p.m. ET on that day, the prize will not be awarded. If you do not have an Instagram account, establishing an account is free. All Instagram terms apply. You must follow @gymboree in order for your entry to be eligible. You can unfollow @gymboree any time after the winners for the applicable Post have been announced. Limit one (1) entry per person per Post. Multiple entrants are not permitted to share the same Instagram account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different accounts or identities will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Entries by any means which subvert the entry process are void.
WINNER DETERMINATION: One (1) potential winner will be selected for each Post in a random drawing each day of the Sweepstakes Period immediately following the entry deadline for that day from among all eligible entries received for that drawing, for a total of six (6) potential winners for the entire Sweepstakes Period. Potential winners will be notified via direct message at or around 8:30 p.m. ET each day and will have 24 hours from notification to respond to Sponsor. The failure to respond to such notification or the potential winner’s noncompliance with these Official Rules may result in disqualification and at Sponsor’s sole discretion, prize may be awarded to an alternate winner for the drawing at issue. Odds of winning depend on the number of eligible entries received for the drawing at issue. Non-winning entries from one drawing will not carry forward into subsequent drawings.
PRIZE (6) (ONE (1) PER POST): $100.00 Gymboree/The Children’s Place digital gift card (terms and conditions apply). Approximate Retail Value (“ARV”): $100.00. Prize is non-assignable and nontransferable and cannot be redeemed for cash. Prize is awarded “as is” with no warranty or guarantee, either express or implied. Winner is responsible for all federal, state and local taxes as well as any costs and expenses associated with prize acceptance and use not specified herein as being provided. Winner may not substitute a prize, but Sponsor reserves the right, at its sole discretion, to substitute a prize with one of comparable or greater value. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per person for the entire sweepstakes.
GRANT OF RIGHTS: By submitting an entry, each entrant grants to Sponsor and its licensees, successors and assigns an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to reproduce, distribute, display, exhibit, exploit, perform, edit, create derivatives of, and otherwise use the entry and all elements of such entry, together with any other material, and the name, Instagram user name, city and state of residence, voice, image and/or likeness of entrant (including, but not limited to, Instagram profile photo), in any and all media now known or hereafter devised, in any manner, in whole or in part, worldwide, without compensation or notification to, or permission from, entrant or any third party, for any purpose whatsoever, including without limitation, for purposes of advertising or trade.
GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects; and (b) to release, discharge and hold harmless Released Parties from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or the acceptance or use of the prize. Released Parties are not responsible for (i) lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, likes, comments, tags, messages, email, or other communications of any kind; (ii) lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications; (iii) failed computer, satellite, telephone or cable transmissions, lines, or technical failure; (iv) jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (v) other errors or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the sweepstakes, the processing of entries, the announcement of the prizes, or in any sweepstakes-related materials; (vi) any incorrect or inaccurate information, whether caused by users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes; or (vii) injury or damage to any person's computer or other device related to or resulting from participating in this sweepstakes. Persons who tamper with or abuse any aspect of the sweepstakes or any Sponsor website or social media account, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the sweepstakes be, in Sponsor’ s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the sweepstakes (or such portion) and if terminated, at its discretion, select potential winner(s) for the drawing(s) at issue at random from all eligible, non-suspect entries received for such drawing(s) prior to action taken or as otherwise deemed fair and appropriate by Sponsor.

WINNERS LIST: The names of the winners will be posted by @gymboree on Instagram following the end of the Sweepstakes Period and winner confirmation.
